Risk & Waiver of Liability
I am fully aware that any activity involving motion of the body, including but not limited to stretching, resistance training, and/or interpersonal contact creates the possibility of serious injury. I further agree to hold Magick Hands Bodyworks and its agents and affiliates harmless from any injury to myself and/or child/children.
As the recipient of services and/or legal parent/guardian, I release and hold harmless Magick Hands Bodyworks, its affiliates, agents, owners and operators, and each of their respective agents and owners from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant and/or the undersigned while in or upon the premises, any premises under the control, supervision, and/or use of Magick Hands Bodyworks, its affiliates, agents, owners or operators, or any of their respective agents or owners, or en route to or from any of said premises.
As the recipient of services and/or the parent/legal guardian, I give permission to Magick Hands Bodyworks, its affiliates, agents, owners and operators, and each of their respective agents and owners to seek medical treatment for the participant(s) in the event they are not able to reach an emergency contact.
I hereby declare that I will disclose any physical/mental problems, restrictions, or condition and/or declare the participant to be in good physical and mental health.
Photo & Video Release
I am aware that Magick Hands Bodyworks photographs or films its bodywork sessions. In the event of a session with full sheets and disrobing of client, recording does not commence until after the client is on the table and will terminate upon end of session, before therapist exits the room and client gets redressed.
These images may be used on the organization’s website, offered for sale in formats such as photographs or DVDs, displayed in public, or used in other ways. I understand and agree that Magick Hands Bodyworks may photograph and videotape myself and/or child/children and use my and/or his/her photographic likeness in all forms and media for any lawful purposes.
Payment Policies
- Magick Hands Bodyworks generally does not accept checks. If a check is accepted and returned as NSF, a $30 returned check fee will be applied, and services will be discontinued until all dues and fees are paid in full.
- Should I dispute a charge through my financial institution, this will constitute a breach of contract, possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any or all current and future agreements.
Drop-In Servicing
- I understand that a non-refundable 50% deposit is required to book and confirm sessions.
- I understand I am permitted to reschedule a maximum of two (2) times before I forfeit my deposit.
- I understand that should I need to cancel or reschedule, I must do so at least 4 hours prior to the start time of my session. Failure to cancel within the timeframe will result in forfeiture of deposit.
- I understand that a “No Call, No Show” will result in full payment of the missed session.
Month-to-Month Memberships
- I understand that my date of initial registration sets my billing cycle and there is no prorating of membership dues.
- I understand that all dues are billed/paid electronically by charge of credit card or bank draft and the electronic payment will be processed every four (4) weeks. Outside of the first four (4) weeks, there will be no refunds once dues have been charged.
- I understand that should I be eligible for a refund, I am not entitled to a full refund. Rather, I will be refunded for unattended classes at the standard rate of $70 per session.
- I understand that in order to cancel or pause my membership, I must complete action via my Fresha account prior to the last day of my billing cycle in order to avoid a charge for the next four (4) weeks.
- I understand that I will be responsible for all dues until cancellation or pause is processed.
- I understand that there will be no prorating of dues for missed sessions. I am responsible for full dues regardless of attendance.
- I understand there is no accumulation of sessions, and missed nor unused sessions roll over to proceeding months.
- I understand sessions may be utilized as schedules permit, so long as I do not exceed four (4) sessions within a billing period.
- I understand that in the event of a five (5) week month, I may purchase a fifth (5th) session at the discounted rate of my current membership.
